The unit
Disciplinary control is a self-protection tool used by the administration to safeguard the principles that govern the public function, as well as the purposes of the state and the interests of the associates. To this end, it makes use of disciplinary law, made up of a series of substantive and procedural rules that allow the authorities to “correct, prevent and sanction” to correct behaviors that disregard the ethics of public service and, for their part, to guarantee “obedience, discipline, righteousness and efficiency” of those who have a special bond with the administration that requires them to rigorously abide by the complex normative articulation that regulates their actions as agents of the state.

The Superior Council of the University, under Law 200 of 1995 (the former single disciplinary code), created the Internal Disciplinary Control Office by means of Agreement No. 070 of 1998. It is a unit attached to the Rector’s Office, and its current functions are established in Superior Council Agreement No. 006 of January 31, 2022.

ADDRESSEES OF THE REGIME
Servants’ Disciplinary
.The addressees of the disciplinary regime of this alma mater are all those who have a legal and regulatory relationship with the institution, such as tenured professors and administrative employees, as well as persons linked through an employment contract, i.e., official workers. Finally, all those persons linked to the temporary modality are also subject to disciplinary action.

.The disciplinary regime applicable to university servants, is contemplated in Law 1952 of 2019, as amended by Law 2094 of 2021, as provided for in Superior Council Agreement No. 006 of January 31, 2022.
INTERNAL AUTHORITIES
Directing the Process
.In the development of the disciplinary process governed by Law 1952 of 2019 (General Disciplinary Code), as amended by Law 2094 of 2021, as well as the provisions of Superior Council Agreement No. 006 of January 31, 2022, intervene as disciplinary authorities:
- Director of Internal Disciplinary Control: a civil servant competent to hear and evaluate the disciplinary news, as well as to advance and evaluate the investigation; if the charges are appropriate, the director must notify this decision, and once this has been done, the director forwards the file to the Judgment Advisor.

Judgment Advisor: a civil servant competent to hear disciplinary proceedings after notification of the statement of charges, who will process them in their entirety until the first instance ruling is issued (although the advisor intervenes in the disciplinary process, the advisor is not part of the structure of the Internal Disciplinary Control Office; the advisor is attached to the rector’s office).

FUNCTIONS OF THE DIRECTOR OF
The Internal Disciplinary Control Office
In accordance with the provisions of Superior Council Agreement No. 006 of January 31, 2022, it is the responsibility of the director of the office to receive disciplinary information (reports, complaints, anonymous writings), evaluate it and proceed with the preliminary investigation, the formal investigation, as well as the formulation and notification of the statement of charges, at which time the action is referred to the Disciplinary Judgment Advisor.

Disciplinary News
In accordance with the provisions of Article 86 of Law 1952 of 2019, as amended by Law 2094 of 2021, “Disciplinary action shall be initiated and advanced ex officio, or by information from a public servant or other means that merit credibility, or by complaint made by any person, and shall not proceed anonymously, except in the events in which it meets the minimum requirements enshrined in Articles 38 of Law 190 of 1995 and Article 27 of Law 24 of 1992.”
